Terms of Service

1 Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the ttriz.com website and its associated services (collectively, the "Service"), operated by LMC ProCreative Pty Ltd ("LMC ProCreative", "we", "us", or "our"). By accessing or using the Service, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Service.

2 Description of Service

ttriz.com provides an interactive platform designed to guide users through the Theory of Inventive Problem Solving (TRIZ) methodology. The Service includes features for defining problems, identifying contradictions, exploring inventive principles, generating reports, and optionally utilizing integrated Artificial Intelligence (AI) analysis features powered by third-party services (like Google Gemini API) to provide further insights.

Service Evolution Notice

ttriz is continuously evolving to better meet user needs. Features mentioned in these Terms, such as user accounts and team collaboration capabilities, may be in various stages of development. We will provide notice of significant feature additions as they become available.

3 User Accounts and Responsibilities (Future Feature)

Currently, the Service operates without requiring user accounts. Should user accounts be implemented in the future, the following terms will apply:

  • You will be required to register for an account to access certain features.
  • You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • You are solely responsible for safeguarding your account password and for any activities or actions under your account, whether or not you have authorized such activities or actions.
  • You agree to notify us immediately at info@procreative.co.za of any unauthorized use of your account or any other breach of security. LMC ProCreative Pty Ltd cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

4 Subscription Tiers and Payments (Future Feature)

The Service is currently offered free of charge, potentially with usage limitations as described within the application or on the website (e.g., limited AI analysis uses). We anticipate introducing subscription tiers in the future:

Intended to offer expanded usage limits, additional features, and priority support for a recurring fee.

Enterprise Tier

Intended for organizations requiring custom solutions, higher usage volumes, team features, or dedicated support.

We reserve the right to introduce, modify, or discontinue subscription tiers, features, and pricing at any time. We will provide reasonable notice of any changes affecting existing users, where applicable (e.g., for future paying subscribers).

5 Use of AI Features

The Service integrates AI analysis features powered by third-party models like Google Gemini. When you opt to use these features:

  • You understand that your relevant Problem-Solving Data (as defined in the Privacy Policy) will be transmitted to the third-party AI service provider (e.g., Google) for processing. This processing is subject to the terms and privacy policies of the respective provider.
  • You acknowledge that AI-generated output is probabilistic and may contain inaccuracies, biases, or unexpected results. AI output is provided for informational and brainstorming purposes only and does not constitute professional advice.
  • You are solely responsible for reviewing, evaluating, and validating the appropriateness, accuracy, and applicability of any AI-generated suggestions or analysis for your specific purpose. LMC ProCreative Pty Ltd makes no warranties regarding the quality, reliability, or suitability of AI-generated content.
  • You agree not to input any highly sensitive personal information, regulated data (e.g., health information under HIPAA unless explicitly permitted by the AI provider's terms and a Business Associate Agreement is in place), confidential information belonging to third parties without authorization, or any content that infringes intellectual property rights or violates applicable laws, into the AI analysis features.
  • If you provide your own API key for the AI service, you are responsible for its security and any costs incurred through its use via our Service.

6 Intellectual Property Rights

Our IP

The Service itself, including the website design, text, graphics, logos, underlying code, algorithms (excluding the core TRIZ methodology itself, which is public domain), and overall structure and arrangement, are the exclusive property of LMC ProCreative Pty Ltd and its licensors, protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service strictly in accordance with these Terms.

Your Content

You retain full ownership and intellectual property rights to the content you create and input into the Service during your consultations, such as your problem statements, parameter selections, notes, diagram data, and the specific combination thereof in your generated reports ("User Content").

License for AI Processing

Solely for the purpose of enabling the AI analysis feature when you choose to use it, you grant LMC ProCreative Pty Ltd and its third-party AI service providers (e.g., Google) a temporary, non-exclusive, worldwide, royalty-free license to use, reproduce, and process your relevant User Content as necessary to generate the AI output and deliver it back to you through the Service. This license terminates once the AI processing is complete and the results are delivered. We will not use your specific User Content to train general AI models publicly available outside of your use of the Service without your explicit prior consent.

7 Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Using the Service for any illegal purpose or in violation of any local, state, national, or international law;
  • Copying, distributing, modifying, reverse engineering, decompiling, disassembling, or attempting to derive the source code of the Service or any part thereof, except to the extent permitted by applicable law;
  • Interfering with or disrupting the integrity or performance of the Service or the data contained therein;
  • Attempting to gain unauthorized access to the Service or its related systems or networks;
  • Transmitting any worms, viruses, trojan horses, or any code of a destructive nature;
  • Using any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission;
  • Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity;
  • Inputting infringing, libelous, or otherwise unlawful or tortious material into the Service;
  • Using the Service in any manner that could damage, disable, overburden, or impair it.

8 Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. USE OF THE SERVICE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, LMC PROCREATIVE PTY LTD, ITS SUBSIDIARIES, ITS AFFILIATES, AND ITS LICENSORS DO NOT WARRANT THAT THE CONTENT (INCLUDING AI-GENERATED CONTENT) IS ACCURATE, RELIABLE, OR CORRECT; THAT THE SERVICE WILL MEET YOUR REQUIREMENTS; THAT THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, UNINTERRUPTED OR SECURE; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DOWNLOADED AT YOUR OWN RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM SUCH DOWNLOAD OR YOUR USE OF THE SERVICE.

9 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LMC PROCREATIVE PTY LTD, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE. UNDER NO CIRCUMSTANCES WILL LMC PROCREATIVE PTY LTD BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT (IF APPLICABLE) OR THE INFORMATION CONTAINED THEREIN.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LMC PROCREATIVE PTY LTD ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT (INCLUDING AI-GENERATED CONTENT); (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICE; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN (IF APPLICABLE); (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND/OR (VII) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY. IN NO EVENT SHALL LMC PROCREATIVE PTY LTD, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE TO YOU FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES OR COSTS IN AN AMOUNT EXCEEDING THE AMOUNT YOU PAID TO LMC PROCREATIVE PTY LTD HEREUNDER IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED U.S. DOLLARS (USD $100.00), WHICHEVER IS GREATER.

THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF LMC PROCREATIVE PTY LTD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

10 Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, likely via a notice on the Service or by email if accounts are implemented. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

11 Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
